emirates7 - In his role as Ruler of Dubai, His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, issued Decree No. (49) of 2024, which governs the appointment of Dubai Government employees to positions within the judicial authorities.
The Decree aims to attract qualified Emirati talent to Dubai’s judiciary while preserving employees' legal status, rights, and financial benefits during their training at the Dubai Judicial Institute. The Institute offers the Judicial and Legal Studies Programme for judges and the Diploma in Legal and Judicial Sciences for Public Prosecutors. Additionally, the Decree ensures employees can retain their government roles while participating in the training.
The Decree applies to eligible civilian and military government employees regulated by relevant human resources laws, such as Law No. (6) of 2012, which manages local military personnel, and Law No. (8) of 2018, which governs Dubai Government human resources. However, Directors General covered by Law No. (8) of 2013 and CEOs under Law No. (8) of 2021 are exempt from its provisions.
The Decree guarantees employees their full salary during training, as per their government entity's human resources regulations, though allowances and additional benefits are excluded. To qualify for training leave, employees must be UAE nationals who meet the admission criteria outlined in Law No. (13) of 2016, which pertains to judicial authorities in Dubai, and its amendments.
While in training, employees must follow the Dubai Judicial Institute’s regulations. After completing the programme and receiving an appointment by the Judicial Council, they are required to serve in a judicial authority for at least five years, unless the Council reduces or waives this requirement. Failure to fulfill this service commitment will necessitate the repayment of all salaries received during training. Additional obligations may be imposed by the Judicial Council.
If an employee does not complete the training or meet its requirements, they will return to their prior government position. The Decree is effective upon its publication in the Official Gazette.
