Abu Dhabi Commercial Court halts global trademark infringement

emirates7 - The Abu Dhabi Commercial Court has issued a final ruling to stop the unauthorized use of a well-known global trademark in the fashion and e-commerce industry, after it was confirmed that a local store had used the trademark without proper licensing or approval.

The case began when the trademark owner filed a lawsuit seeking to shut down a store that had been using its brand name and logo on products, storefronts, advertising, and digital platforms. This misuse created a false impression among customers that the store was officially affiliated with the brand, which operates exclusively online and does not have physical retail outlets.

After reviewing the case through various judicial stages, the court ruled in favor of the trademark owner, affirming its legal right to protect its registered intellectual property. The court emphasized that the infringement violated both UAE laws and international intellectual property agreements.

The court ordered an immediate end to all infringing actions, including the removal of the counterfeit trade name from the Abu Dhabi Department of Economic Development’s records and from all commercial registries throughout the UAE. Additionally, the store was prohibited from using the brand’s trademarks in any format—whether in its business name, online platforms, or social media.

The store was also instructed to halt the sale of all products bearing the trademark in question and to remove any associated signage, merchandise, and promotional content.

The ruling was upheld on appeal, with the Court of Cassation confirming the Commercial Court’s verdict, making the decision final and legally binding.

This judgment strengthens investor trust and affirms the UAE’s commitment to protecting intellectual property rights, highlighting the efficiency of its judiciary in handling economically significant cases.
